Weingarten權利

瞭解你的權利：代表權

如果上司或經理要求你面談，調查情況並議定處罰，則你所擁有的明確代理權利可以概括如下：

1. 你有權要求工會代表出席。
2. 若希望代表在場，你必須事先申請。
3. 如果不瞭解會面原因，直接詢問經理：會面是否會導致處罰。
4. 如果經理拒絕代表到場，在證人面前重複你的要求。不要拒絕到會，但也不要回答任何問題。記錄會議內容。會議結束就給代表打電話。
5. 你有權在會前和會中與代表私下交流。
6. 代表不僅是旁觀者，他/她有權積極參與會議。

上述權利名為“Weingarten權利”，它源於最高法院1975年的一項裁決。（國家勞資關係委員會對J.Weingarten）。不加利用就意味著放棄，所有權利都是如此。

這項聲明可能保住你的工作：

"If this discussion could in any way lead to my being disciplined or terminated I respectfully request that my steward be present at the meeting. Without representation present, I choose not to respond to any questions or statements."
